INTRODUCTION

St Columbans Mission Society Trust Board (Charity Services No: CC22117) is a Catholic Religious not-for-profit organisation registered as a Charity with the New Zealand Charities Registration Board.

Please read these Terms and Conditions carefully before accessing or using the Website. If you do not agree with these Terms and Conditions, you should not accept them. If you do not accept these Terms and Conditions, you must not access or use the Website.

 

 

Content means any words, text, images, materials, data, logos, photos, videos and graphics howsoever appearing on or accessible through use of the Website.

Copyright Act means Copyright Act 1994.

Terms and Conditions means these terms and conditions as amended from time-to-time by St Columbans Mission Society.

Website means St Columbans Mission Society’s website located at the domain: https://www.columban.org.nz.

2.1  Use of the Website is governed by these Terms and Conditions, our Privacy Policy and our Comments & Social Media Policy. 
2.2  By using the Website, you agree to these Terms and Conditions, Privacy Policy and Comments & Social Media Policy.
2.3  St Columbans Mission Society may change or revise these Terms and Conditions at any time. Notice of any changes will be provided by publishing the revised Terms and Conditions on this website only.
2.4  The Website must only be used for personal or non-commercial purposes.
2.5  St Columbans Mission Society will use reasonable efforts to  ensure that information or content on the Website is accurate, reliable and complete. However, information or content on the Website may be of a general nature only and may also change from time to time. To ensure that you receive the most up to date information, you should not rely exclusively on content or statements made on the Website and should contact St Columbans Mission Society, as required.
2.6  St Columbans Mission Society may at any time and without notice, modify or update or interrupt, suspend or discontinue access to the Website.
2.7  If a provision, or part-provision, in these Terms and Conditions is held to be invalid or unenforceable, that provision, or part-provision, is severable without affecting the validity or enforceability of the remaining part of that provision or the other provisions.
2.8  Any dispute or claim arising out of or in connection with these Terms and Conditions (including non-contractual disputes or claims) will be governed by the laws of New Zealand and will be subject to the non-exclusive jurisdiction of the courts of New Zealand.
2.9  No failure by St Columbans Mission Society to insist upon or enforce strict compliance with these Terms and Conditions will constitute a waiver of its rights or remedies.

3.1     To the fullest extent by permitted by law, St Columbans Mission Society makes no warranty or representation of any kind in relation to:
3.1.1  the accuracy, adequacy, fitness for purpose, reliability or completeness of the information and/or content on the Website;
3.1.2  any website accessible from the Website by hyperlink or otherwise that is not maintained by St Columbans Missionary Society;
3.1.3  the access or use of the Website including whether it will be uninterrupted or error-free or that the Website or any Content on or accessible through the Website is free from errors or viruses, worms, trojan horses, time bomb, cancelbot or other harmful components.
3.2    To the fullest extent permitted by law, St Columbans Mission Society expressly disclaims liability for any loss, claim, cost, liability, expense or damages whatsoever including consequential loss (which includes loss of profits and legal expenses) whether arising in contract, tort (including negligence) or otherwise, suffered by you arising out of or in connection with the Website or our social media pages, including any reliance by you on the Content, your use or access to the Website or St Columbans Mission Society’s failure to provide the Website.
3.3    Except as otherwise required by law, you accept all risks and responsibility for all loss, damage, costs and other consequences resulting from your use of the Website and/or our social media pages or the material on or accessible through the Website and/or our social media pages.

4.1     You agree to indemnify and hold harmless St Columbans Mission Society and its officers, employees and agents from and against all losses, damages and costs resulting from:
4.1.1  your access to or use of the Website or our social media pages;
4.1.2  a breach of these Terms and Conditions by you; and
4.1.3  the infringement of any intellectual property right or right of any person or entity by you or an associated party.

5.1   Subject to clauses 5.3, 5.5 and 5.6, except for use permitted under the Copyright Act, you must not use any Content (including literary or artistic works within the meaning of the Copyright Act) without the prior written consent of St Columbans Mission Society. 
5.2   Without derogating from clause 5.1, you must not, in respect of any Content, create a derivative work, copy, reproduce, adapt, upload, link to, frame, perform in public, distribute, store, publish, disclose, display or transmit in any form.
5.3   St Columbans Mission Society may impose conditions (including the requirement to acknowledge St Columbans Mission Society as author of the Content) on any consent granted by it under clause 5.1.
5.4   St Columbans Mission Society may revoke any consent granted under clause 5.1 at will including where any conditions of use have been breached or the Content has been distorted, inappropriately associated with other material or otherwise subject to derogative treatment within the meaning of the Copyright Act.
5.5   Where St Columbans Mission Society does not own copyright in the Content or any content on our social media pages you must have prior authorisation and permission from the copyright owner to use or reproduce any such content, in addition to St Columbans Mission Society’s consent under clause 5.1.
5.6   Where St Columbans Mission Society owns copyright of content or material in this site (including downloadable files or material), St Columbans Mission Society may receive compensation for the use of their content by educational institutions and governments, including from licensing schemes by Copyright Licensing New Zealand.

 

6.1 All pricing and transactions on the Website are stated in New Zealand Dollars (NZD) and are secured using 256 Bit Strong SSL (Secure Sockets Layer) encryption technology. Your transactions on this site are protected by RapidSSL (www.rapidssl.com/australia) that securely passes transaction data to the eWAY secure online payment gateway (www.eway.com.au). 6.2 All transactions on the Website, (including online donations and website shopping orders) must be paid by VISA and MasterCard only. All goods available on the online store remain the property of St Columbans Mission Society until full payment is received. 6.3 Unless expressly indicated, all prices are quoted on a GST-exclusive basis. Prices are subject to change without notice. St Columbans Mission Society reserve the right to rectify prices quoted in the invoice, if found to be incorrect. 6.4 If you believe that there has been an error in debiting your account (including any regular direct debit payments) you should notify St Columbans Mission Society as soon as possible and within a reasonable time after the relevant account transaction. 6.5 While St Columbans Mission Society takes utmost care in the security of your data and transactions on our systems, we are not responsible for any unauthorised access to your personal information or loss of or corruption of data caused by circumstances beyond our reasonable control including any computer virus or Trojan or via any system from an Internet Service Provider linking your computer system with ours. 6.6 If you have any reason to believe that there has been unauthorised use of your personal information or your credit card details, please notify us as soon as possible. 6.7 St Columbans Mission Society is committed to providing quality products and services to our customers. If for any reason you are not completely satisfied with any product or item, in addition to your rights under New Zealand Consumer Law, we will happily exchange, replace, credit your account or refund your money provided that: (a) you return the unwanted item(s) within 14 days from the date of delivery; (b) the unwanted item(s) are returned in the original new and unused condition with all packaging and tags attached; and (c) proof of purchase is received with the returning item(s). Please return the item(s) along with a copy of the receipt and a brief note instructing us what action you would like us to take. 6.8 All return postage costs will be at your expense. St Columbans Mission Society will not be liable for any damage or loss of returned item(s) if the return parcel does not arrive or is lost in transit or if the goods are damaged in any way during transit. For exchanges or returns where an item(s) has been deemed faulty or damaged or lost due to St Columbans Mission Society's fault, return postage costs will be paid at the expense of St Columbans Mission Society. 6.9 St Columbans Mission Society reserves the right to assess the condition and age of returned goods prior to providing a replacement, exchange, credit or refund. Subject to your rights under New Zealand Consumer Law, this may result in a repair, exchange, credit or refund request being refused. 6.10 Refunds will be issued using your original payment method.

7.1   St Columbans Mission Society Trust Board is a Catholic Religious not-for-profit organisation registered as a Charity with the New Zealand Charities Registration Board.
7.2   Donations to St Columbans Mission Society are tax-deductible.
7.3   At the end of Tax Year 31 March we will email or post a Tax Receipt for all your donations for the year.
7.4   You should always check your account statement to verify that the amount(s) debited from your account is correct.
7.5   You must notify us if you believe that your account has been incorrectly debited. Once we receive your notice we will conduct an investigation.
(a)   If we conclude as a result of our investigations that your account has been incorrectly debited we will take reasonable steps to arrange for your financial institution to adjust your account (including interest and charges) accordingly. 
(b)   If we conclude as a result of our investigations that your account has not been incorrectly debited we will notify you accordingly and provide reasons and any evidence for this finding. If we cannot resolve the matter you may be required to contact your financial institution.
7.6   If you wish to cancel, defer or alter a recurring or regular online donation or direct debit payment, you must notify St Columbans Mission Society at least 14 clear business days prior to the next scheduled payment date to effect any cancellation. Please provide details of your donation, such as name, address, and Columban Benefactor ID number (if applicable) for ease of processing.
7.7   It is your responsibility to ensure that there are sufficient clear funds available in your account for any direct debit payments. If there are insufficient clear funds in your account to meet a debit payment: 
(a)   you may be charged a fee and/or interest by your financial institution; 
(b)   you may also incur fees or charges imposed or incurred by St Columbans Mission Society.
7.8   It is your responsibility to check that the account details you have provided St Columbans Mission Society are correct by checking them against a recent account statement or with your financial institution.
7.9   St Columbans Mission Society may send direct debit notices or communication either electronically to your email address or by post to the address you have given us. Alternatively, we may be required to contact you by phone on the number you have provided us.
